아시아인권위, 세월호 특별법 국제적 연대 호소
-대책위 영문 전단 누리집에 올려놓고 소개
-수사권, 기소권 보장되는 특별법 제정하라
세월호 참사의 진실을 알리고 진상을 밝히는 특별법을 제정하라는 유가족 및 한국 시민단체의 요구에 국제적인 연대의 움직임이 일고 있다.
아시아인권위원회는 22일 홈페이지에 세월호 참사 국민대책회의에서 제작한 영문 전단지를 올려놓고 세월호 특별법 제정을 위한 국제적인 관심과 행동을 촉구했다.
‘We want the truth of the Sewol Ferry Tragedy-한국: 우리는 세월호 참사의 진실을 원한다’는 제목의 이 호소문은 사고의 배경에 대해서 설명한 뒤 ▲구조작업 ▲언론의 정확한 보도실패 ▲안전수칙 검사의 실패와 비정규직 노동자 ▲이윤 대 안전 ▲세월호 특별법 제정 등에서 우려되는 사항을 진단한 뒤 요구사항과 이를 지지하는 국제적인 연대 지지를 호소하고 있다.
호소문은 ‘희생자들의 가족들은 투명하고 독립적인 범죄 조사와 기소를 위한 특별법 제정을 계속해서 요구해왔다’며 그러나 정부와 집권당은 국가에서 전례가 없었다는 핑계로 이 요구를 거부하고 있다고 밝히고 있다.
대책위는 ▲ 투명하고 독립적인 형사 수사권과 기소권을 보장하는 특별법을 제정할 것 ▲ 향후에 비슷한 비극이 발생하지 않도록 모든 가능한 조취를 취하고 이 새로운 안전대책은 대중에게 반드시 명확하게 전달되어야 할 것 ▲ 언론매체는 정부의 영향으로부터 독립적이어야 할 것 ▲ 내부고발자를 보호할 것 ▲국민은 참사의 원인과 구조작업의 실패에 관한 자신들의 의심을 법적인 기소의 위협없이 표현할 권리를 가져야 할 것 등을 요구하고 있다.
이어 연대 지지의 방법으로 ▲ 세월호 비극을 알리기위한 일인 혹은 단체 시위 ▲ 세월호 희생자들을 추모하는 촛불집회 개최 ▲ 세월호 피해자들에게 연대의 메시지 보내기 ▲ 세월호 참사의 진실에 대한 인식을 고양시키기 등을 국제사회에 호소하고 있다.
아시아 인권위가 대책회의의 영문 호소문을 자신들의 홈페이지에 올려놓음에 따라 지역 국가 인권위가 이에 대한 연대 지지를 호소할 것으로 예상되며 각 국가 활동가들과 단체들의 관심을 끌 것으로 보여 세월호 진상 밝히기와 특별법 제정은 국제적인 연대의 장으로 확산될 것으로 보인다.
이로서 박근혜 정부의 세월호 덮기 노력이 무산되고 박근혜 정부는 국제적인 압박에 부딪칠 것으로 예상된다.

1. Background
1. 배경설명
The Sewol Ferry bound to Jeju Island from Inchon capsized on 16 April 2014 carrying 476 passengers, the majority of them students from Danwon High School.
2014년 4월 16일 인천에서 제주도로 향하던 세월호는 대부분이 단원고등학교 학생들이었던 476명의 승객을 태운 채로 전복됐다.
It is still unclear why the ship capsized but when it happened, overloaded cargos fell down to the sea and the ferry lost its center of gravity. The ferry was carrying 2,142 tons of cargo with 762 tons of ballast water. According to the relevant regulation, it supposed carry 1,077 tons of cargo when it has 1565.8 tons of ballast water. It was later found that the ferry was renovated to carry more cargos for financial benefits.
배가 전복된 원인은 알지 못하나 사고가 났을 당시 과적된 화물이 바다로 떨어졌고 여객선은 무게중심을 잃었다. 여객선은 2,142톤의 화물과 762톤의 평행수를 싣고 있었다. 관계규정에 따르면 세월호는 1,565톤의 평행수를 적재했을 때 1,077톤의 화물을 나를 수 있도록 되어있었다. 재정적 이윤을 위해 더 많은 화물을 실을 수 있도록 이 배가 개조되었음이 후에 밝혀졌다.
During the rescue operation, there was an overall lack of coordination between the Coast Guard, the Navy, and other support groups on the ground.
구조작업이 진행되는 동안 해안경비대, 해군, 그리고 현장의 다른 지원단체 사이에 전반적으로 협조가 이루어지지 않았다.
As of 11 June 2014, the disaster caused the death of 304 people including 10 missing people. The rescue operation is ongoing. Two divers and five rescuers lost their lives during the rescue operation.
2014년 6월 11일 현재로 이 참사로 10명의 실종자를 포함해 304명이 사망했다. 구조작업은 진행중에 있다. 두 명의 잠수부와 5명의 구조대원이 구조작업 중 목숨을 잃었다.

The captain left the ferry before the passengers while ordering them to ‘stay inside the ferry’. Also, he did not report the accident immediately. Instead of reporting the incident to the coast guard, he reported it to the National Intelligence Service. Why did he make such orders to the passengers? Why did he not report the accident immediately?
선장은 승객들에게 ‘배 안에 가만히 있으라’는 지시를 내리고는 승객보다 앞서 배에서 탈출했다. 또한 그는 사건을 즉시 보고하지 않았다. 그는 해양경비대에 신고하는 대신 국가정보원에 보고했다. 왜 그는 그런 지시를 승객에게 내렸을까? 왜 그는 사건을 즉시 신고하지 않았을까?
Coast Guard rescued the captain of the ship and its staffs earlier than any other passengers. Also, they did not order people to leave the ferry and did not enter the ferry to rescue people even though they knew that passengers were still inside. Why did the Coast Guard not act urgently to save the people sinking?
해양경비대는 다른 승객보다 먼저 선장과 선원들을 구조했다. 또한 그들은 사람들에게 배에서 탈출하라는 지시를 내리지 않았으며 승객들이 여전히 안에 있는 줄 알면서도 사람들을 구하러 배 안으로 들어가지 않았다. 왜 해안경비대는 침몰하는 사람들을 구조하기 위해 긴급하게 행동하지 않았을까?
The police did not immediately arrest the captain and even after the arrest, the police took the captain, a suspect, to his own house instead of detaining him at the police station. This created a huge controversy in regards to the independence of the investigation.
경찰은 즉시 선장을 체포하지 않았고 체포한 후에도 피의자인 선장을 경찰서에 구류시키지 않고 자기집으로 데려갔다. 이는 수사의 독립성과 관련해 커다란 논란을 불러일으켰다.
During the rescue operation, there have been inconsistencies in reporting the actual situation on the ground and major discrepancies between the Coast guard rescue effort report versus the Government briefing report. At the beginning, the Government announced that most passengers were rescued and then it changed its position after few hours.
구조작업이 이뤄지는 동안, 현장의 실제상황을 보도하는 데 있어서 불일치가 있었고, 해양경비대 구조노력에 대한 보도와 정부의 보고 사이에는 심한 차이가 있었다. 처음 정부는 대부분의 승객들이 구조되었다고 발표했으나, 몇 시간 후에 그 입장을 바꿨다.
It is not verified where President Park Geun-hye was for 7 hours during the so-called ‘golden hour’. The “golden hour” is a medical term referring to the time in which rescue personnel need to start treating a patient to give them the best chance of survival.
이른바 ‘황금시간’인 7시간 동안 박근혜 대통령이 어디에 있었는지 확인되지 않았다. ‘황금시간’이란 의학용어로서 환자에게 생존할 최고의 기회를 주기 위해 구조대원이 환자의 치료를 시작해야 할 시간대를 가리킨다.
Failure of accurate report by Media
언론의 정확한 보도 실패
At the beginning of the incident, several public broadcasting cooperations reported that all passengers were rescued, and other media just copied these false reports, which created a huge confusion and false expectation among the general public.
사건 초기에, 일부 방송사가 모든 승객이 구조됐다고 보도하자, 다른 언론사들도 이 잘못된 보도를 그대로 따라했고, 이것으로 인해 일반대중들은 큰 혼란에 빠지고 잘못된 기대를 하게 되었다.
Also, the Government and the Navy reported that they were providing all possible rescue personnel and equipment for the rescue operation and the media just copied their announcement without checking. Later, during the parliamentarian investigation, it was found that the Government’s report on the rescue operation is quite different from the situation on the ground.
또한, 정부와 해군이 가능한 모든 구조 인력과 장비를 투입하고 있다고 보고하자 언론은 검토하지 않은 채 그대로 보도했다. 후에, 구조작업에 대한 정부의 보고와 현장에서의 상황은 아주 다르다는 것이 국회청문회에서 밝혀졌다.
Former editor-in-chief of the Korean Broadcasting System (KBS) disclosed the President Office’s control of broadcasters and resigned from his position[1]. To protest against the President Office’s control of the media, KBS staff members went on a strike and 5,623 media workers issued a statement expressing their regret on how they reported on the Sewol Ferry Tragedy and apologized that they did not resist against the authorities when they tried to manipulate the media.
전 KBS 편집국장이 방송인에 대한 청와대의 통제를 폭로하고 사임했다[1]. 청와대의 언론통제에 대해 항의하기 위해, KBS 직원들이 파업에 돌입했으며, 언론종사자 5,623 명이 세월호참사에 대한 자신들의 보도에 대해 유감을 표명하는 성명서를 발표하고 정부당국이 언론을 조종하려 했을 때에, 정부당국에 저항하지 못한 점을 사과했다.

19 of the 33 crew staffs on the Sewol Ferry were irregular workers – including the captain. The wage of the captain was only 60~70% of other captains. Irregular workers with temporary employment contracts and no job security causes poor working conditions and the oversight of safety awareness.
세월호의 승무원들 33명 중 선장을 포함한 19명이 비정규직이었다. 선장의 월급이 다른 선장들의 월급의 60-70%에 지나지 않았다. 임시 고용계약을 맺고 있고 직업에 대한 보장이 없는 비정규직 노동자들이 열악한 작업환경과 안전의식 간과의 원인이 되었다.
The deregulation of South Korea’s shipping industry
한국 선박산업의 규제완하
When the Sewol tragedy happened, it was already 21 years old. It was imported from Japan when it was 18 years old. The deregulation of South Korea’s shipping industry under the former President Lee Myung-bak (2008-2013) resulted in a rise of unsafe practices. Deregulation extended ferry service periods from 20 to 30 years, allowing older ships such as the Sewol to continue operating[2].
세월호 참사가 일어났을 때, 세월호는 이미 21년이 된 배였다. 그 배는 18년이나 된 배로서 일본에서 수입됐다. 이명박 대통령 정권 하(2008년-2013년)에서의 한국 선박산업의 규제완하는 위험한 관행이 증가하는 결과를 초래했다. 규제완하는 세월호와 같은 낡은 배들을 계속해서 운행하도록 여객선의 운항기간을 20년에서 30년으로 연장시켜줬다[2].

The Sewol ferry was illegally renovated to carry extra illegal cargos in order to bring in higher profits. For one year, the Sewol Ferry had carried excess cargo on its Incheon-Jeju route 139 times, resulting in almost US$3 million in profit for the owner, Cheonghaejin Marine Company. However, the Sewol Ferry passed the Government’s safety check instead of being regulated. It is mainly because that the Government let the Shipping Association who is the main stakeholder do self-imposed control of the safety check under the name of deregulation.
세월호는 더 높은 이윤을 내기 위해 불법적인 추가화물을 운반하도록 불법개조됐다. 한 해 동안, 세월호는 139차례에 걸쳐 인천 제주 간 항로에서 과적된 화물을 운반했고 결과로 거의 3백만 달러의 이윤을 소유주인 청해진해운에 남겨줬다. 하지만 세월호는 정부의 제제를 받는 것이 아니라 안전검사를 통과했다. 이는 주로 정부가 규제완하라는 명목 하에 주요 이해관계자인 선박협회로 하여금 스스로 안전검사의 규제를 시행하도록 했기 때문이다.
No enforcement of safety regulations is not only confined to the shipping industry but can also be seen in other aspects of South Korean society.
안전규제의 미시행은 선박산업에 한정된 것이 아니라 한국 사회의 다른 부분들에서도 볼 수 있다.
Enactment of the Special Bill on Sewol
세월호 특별법 제정
Victims’ families have continuously called to enact a special law for a transparent and independent criminal investigation and indictment. The special law should also include strong measures to prevent further tragedies like the Sewol Ferry tragedy. Within two months, Sewol victims’ families collected around 4 million signature petitions in support of their demands, when the total population of South Korea is 50 million people.
희생자들의 가족들은 투명하고 독립적인 범죄 조사와 기소를 위한 특별법 제정을 계속해서 요구해왔다. 특별법은 또한 더 이상 세월호 참사와 같은 참극이 일어나지 않도록 예방하기 위한 강력한 대책을 포함해야만 한다. 두 달 만에 세월호 희생자 가족들은 자신들의 요구를 지지하는 청원에 전체인구 5,000만명인 한국에서 4백만 명의 서명을 모았다.
The Government and the ruling party are refusing to accept the demands under the pretext that we did not have precedent in the country. In South Korea, the prosecutors’ office has an authority to indictment.
정부와 집권당은 국가에서 전례가 없었다는 핑계로 이 요구를 거부하고 있다. 한국에서 기소권은 검찰이 가지고 있다.

• Enact a special law guaranteeing a transparent and independent criminal investigation and indictment.
- 투명하고 독립적인 형사 수사권과 기소권을 보장하는 특별법을 제정하라.
• Take all possible measures to avoid similar tragedies in the future. These new safety measures must be clearly communicated with the public.
- 향후에 비슷한 비극이 발생하지않도록 모든 가능한 조취를 취하라. 이 새로운 안전대책은 대중에게 반드시 명확하게 전달되어야 한다.
• The media to be independent of Government influence.
- 언론매체는 정부의 영향으로부터 독립적이어야 한다.
• Protect whistle blowers. People should have the right to voice their doubts in regards to the causes of the tragedy and the failure of the rescue operation without the threat of being legally prosecuted.
- 내부고발자를 보호하라. 국민은 참사의 원인과 구조작업의 실패에 관한 자신들의 의심을 법적인 기소의 위협없이 표현할 권리를 가져야 한다.
