국정원이 작년 대한민국 대선에 개입한 혐의를 조사하기 위한 국정조사가 큰 성과없이 이번주 막을 내렸다. 여당 새누리당은 청문회의 매 단계마다 방해를 했고, 심지어 범죄에 연관된 몇몇 고위 인사를 청문회 증인으로 채택하는 것까지도 반대했다.
Lee Sang-Kyu, an opposition lawmaker of the United Progressive Party, went on a hunger strike on August 21, 2013 in front of Chung Wha Dae (the presidential office) demanding a thorough re-investigation into this matter to expose the truth and urging President Park to take responsibility for her part in this. As a member of the Parliamentary Investigative Committee he had participated in the unsuccessful parliamentary investigation and uses this hunger strike to display his frustrations.

They tried to deliver the letter in person to the presidential office (as seen in the photographs above). However, their attempt was unsuccessful, being stopped by hundreds of police officers. On the next day they made a second attempt and were able to give the letter to one of the presidential secretaries for political affairs.

Dear Ms. President,
According to the 1st Article of our Constitution South Korea is a democratic nation, the nation's sovereignty belongs to the people and all the power comes from the people. The National Intelligence Service (NIS)' illegal intervention in last year’s presidential election and the police's announcement of the false investigation results seriously compromised voters' rights in our nation. It was a crime against democracy and our constitutional rights.
Article 66 of the Constitution stipulates that a primary role of the president is to defend the Constitution. Therefore, as the opposition lawmakers at ‘the Parliamentary Investigative Committee' we urge you to express your position in this matter and to take responsibility for what happened.
The very foundations of a democratic country are based on fair elections. If state agencies have intervened illegally in an election and by doing so have compromised our right to suffrage, then our nation is no longer a democracy and the nation's sovereignty no longer belongs to the people. Therefore, the legitimacy of state power obtained through such illegal acts cannot be justified. If it were proven that CIA intervened in a US presidential election illegally and the FBI announced false investigation results to whitewash this then it would not be possible for the President of the Unites Stares to keep their presidency.
In 2007 you visited the National 3.15 Democracy Cemetery which honors the spirits of the protests that erupted against the electoral fraud in Masan on March 15, 1960. Since you very well know of this event in history you should learn a lesson from it.
If you do not get to the truth now, these allegations of the NIS' illegal intervention in the election will become huge obstacles for you in managing the nation for the next 5 years and furthermore more serious situations may arise.
President Park, you claimed repeatedly that the female spy agent was innocent up to the day before the Election Day last year. On December 14th you called for an emergency news conference and insisted "in case the agent is proven innocent Moon Jae-In, the candidate of the opposition party, will have to take responsibility for accusing her of the crime". During the 3rd TV presidential debate on December 16, 2012 you even said with such confidence that "there was absolutely no evidence of the spy agency's illegal acts", which was before the police announced the results from their investigation into this matters.
For the past 8 months since you took office you have not expressed a word regarding the allegations of the NIS' illegal intervention in the presidential election. Even though Chae Dong-Uk, the chief of the prosecution who was appointed by you, accused and indicted the chiefs of the spy agency and the police for the crime after a few months of probing.
It is derelict of you, as the president, if you keep silent on this matter. The prime responsibility to run a fair election falls on you as the head of the government. The NIS is under the direct control of the President and therefore no one else but you must express your position clearly.
However, you have kept silent all this time. 'The silence of the President' is now even hampering exposing the truth and punishing the involved.
All throughout the parliamentary investigation into the allegations involving the NIS the ruling Saenuri Party has stood in the way. Because of their strong opposition we could not bring out at the hearings as witnesses Kim Moo-Sung, the general director of Park’s camp, or Kwon Young-Se, chief of election operations, although your election camp was mainly managed by these two.
Through all the difficulties at each and every step the parliamentary investigation clearly disclosed at least that the allegations related to the NIS’ illegal intervention in the election and the police's false investigation results were in fact true. You are the one who has benefited the most from these criminal acts committed by these state agencies and you must take responsibility for that.
Therefore, we, the opposition lawmakers at the Parliamentary Investigative Committee, urge you, the President, to meet our four demands.
Firstly, you, who are supposed to uphold the Constitution, must express your position on how you take responsibility for the NIS’ illegal intervention in the presidential election and by so doing committed a crime against constitutionalism and damaging the very foundations of our democratic country.
Secondly, you must make decision about placing Kim Moo-Sung, the general director of Park’s camp, and Kwon Young-Se, chief of election operations, as witnesses in the parliamentary hearings. It is your responsibility as the President that you emphasize the rule of law before your personal care and gratitude for your subordinates.
Thirdly, you must see to the punishment of the people in the NIS and the police who were involved in these crimes. If criminals are not properly punished the law and order of our nation will collapse.
Fourthly, you must dismiss Nam Jae-Jun, the current chief of the NIS, who leaked national security secrets for his political intention. You also should take steps to prevent the recurrence of such crimes. As it was already clearly proven during the parliamentary investigation your order of a ‘self reform’ of the NIS within the agency is absurd and is going to fail. You must provide our nation with complete plans of the NIS reform and the prevention of recurrence of crimes such as this.
The goal of all these illegal and fraudulent acts during the presidential election was to make you the President. You must now come out of your long silence and show the nation how you are going to take responsibility for all these fraudulent acts related to your election.

국정원 불법 대선개입과 국정조사 방해행위,
박근혜 대통령이 책임져야 합니다.
박근혜 대통령께,
대한민국 헌법 제1조에 따르면 대한민국은 민주공화국이며, 대한민국의 주권은 국민에게 있고, 모든 권력은 국민으로부터 나옵니다. 그러나 지난 2012년 국정원의 불법 대선 개입과 경찰의 허위 수사발표는 국민들의 표심을 왜곡했습니다. 헌정을 유린하고 민주주의를 훼손했습니다.
대한민국 헌법 제66조에 따르면 대통령은 헌법을 수호할 책무를 지게 되어있습니다. 대통령께서 헌법수호의 최고책임자인만큼 ‘국정원 국정조사 특위’ 야당위원들은 대통령께 이에 대한 입장과 책임을 요구하고자 합니다.
민주주의 국가의 근간은 바로 공정한 선거에 있습니다. 그런데 국가기관이 불법적으로 선거에 개입하고 국민의 기본권을 훼손했다면 대한민국은 더 이상 민주공화국이 아니며, 주권 역시 국민에게 있는 것이 아닙니다. 또한, 그렇게 탄생한 국가의 권력 역시 정당성을 가질 수 없습니다. 미국 CIA가 대선에 불법적으로 개입하고 FBI가 허위 수사발표를 했다면 미국 대통령이 대통령직을 유지할 수 있었을까요?
박근혜 대통령께서는 지난 2007년, 3.15 부정선거에 반발하며 마산에서 일어난 대규모 시위의 정신을 기리는 3.15 민주묘지를 참배한바 있습니다. 3.15 부정선거가 시사하는 바를 잘 알고 있는 만큼 반면교사로 삼길 바랍니다.
지금 진실을 규명하고 바로잡지 않으면 국정원 불법 대선개입 사태는 향후 5년간 정국을 운영하는데 두고두고 큰 부담으로 작용할 것이며, 그보다 더 심각한 사태를 초래할 수도 있을 것입니다.
박근혜 대통령은 지난해 대통령 선거 당일 전까지 국정원 여직원 무죄를 수차례 주장했습니다. 지난해 12월 14일에는 긴급기자회견을 열어 “허위사실로 밝혀지면 문재인 후보가 책임져야 한다”고 주장했습니다. 또, 경찰 수사 결과 발표가 나오기 전인 12월 16일에는3차 TV토론에서 “이미 증거가 하나도 없다고 나왔다”고 단언하기 까지 했습니다.
그러나 대통령에 당선된 이후에는, 박근혜 대통령이 임명한 채동욱 검찰총장 휘하의 검찰이 국정원과 경찰의 범죄 혐의를 분명하게 입증했음에도 불구하고 약 8개월간 국정원 불법 대선개입 사태에 대해 단 한마디도 입장을 표명하지 않았습니다.
국정원 불법 대선개입 사태에 대한 대통령의 침묵은 헌법책임자로서 직무유기하는 것입니다. 선거 공정성의 책무는 우선적으로 국정의 책임자인 대통령에게 있습니다. 그리고 국정원은 정부조직법상 대통령 직속기관으로 되어있기 때문에 총리도, 그 누구도 아닌 대통령이 명확한 입장을 밝히는 것이 당연합니다.
그러나 박근혜 대통령께서는 침묵으로 일관해왔으며 ‘대통령의 침묵’은 진실 규명과 책임자 처벌에 저해가 되고 있습니다.
국정원 국정조사에서 새누리당은 끊임없이 방해책동을 벌이고 있으며 2012년 대선 당시 박근혜 캠프의 일등공신이었던 김무성 선대본부장, 권영세 종합상황실장의 증인채택도 이뤄지지 않고 있습니다.
그러한 어려움 속에서도 이번 국정조사를 통해 국정원 불법 대선개입과 경찰의 수사 축소․은폐에 대한 국민적 의혹은 단순한 의혹인 아닌 사실로 드러났습니다.
그리고 그러한 일련의 사태로 인해 가장 큰 수혜자가 된 사람은 박근혜 대통령입니다.
이에 국정원 국조특위 야당 위원들은 박근혜 대통령께 다음과 같은 네가지를 요구합니다.
첫째, 헌법수호의 최고책임자로서 헌정 유린, 국기 문란을 야기한 국정원 불법 대선개입 사태에 대해 박근혜 대통령이 어떤 책임을 질 것인지 명확한 입장을 요구합니다.
둘째, 2012년 대선 당시 박근혜 후보 캠프의 김무성 선대본부장, 권영세 종합상황실장이 국정조사 증인으로 채택되어, 청문회 장에 나올 수 있도록 대통령의 결단을 요구합니다.이는 일등공신에 대한 개인적인 인정과 배려 이전에 법치주의를 실현해야 할 대통령으로서의 책무입니다.
셋째, 국정원 불법 대선개입 사태 및 경찰 수사 축소․은폐와 관련된 책임자들의 처벌을 요구합니다. 범죄 혐의가 입증된 자들에 대한 엄단이 이루어지지 않는다면 국가의 기강이 무너질 것입니다.
넷째, 국가기밀을 무단으로 유출한 남재준 국정원장을 즉각 해임하고 재발방지 대책을 마련할 것을 요구합니다. 특히, 이번 국정조사를 통해 국정원의 ‘셀프개혁’은 허무맹랑한 레토릭에 그칠 수밖에 없음이 분명하게 드러났습니다. 국정원 개혁방안을 비롯해 총체적인 재발 방지 대책을 국민에게 제시해야 합니다.
지난 2012년 대선 과정에서 벌어졌던 온갖 불법․부정행위는 딱 하나, ‘박근혜 대통령 만들기’를 위해서였습니다. 본인 선거과정에서 벌어졌던 불미스런 사태에 대해 박근혜 대통령은 이제 침묵을 깨고 본인 스스로 어떻게 책임질 것인지 국민과 역사 앞에 밝히길 바랍니다.
